The information, content, services, and features available on the AgriTrust Marketplace Platform at https://agritrust-marketplace.com (the “Platform”) are provided by AgriTrust Marketplace Limited (“AgriTrust”) on an “as is” and “as available” basis. AgriTrust makes no representations or warranties of any kind, express or implied, regarding the operation of the Platform, the accuracy or completeness of any content, or the suitability of any product or service for any particular purpose.
To the fullest extent permitted by the laws of the Republic of Ghana, AgriTrust expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Your use of the Platform is entirely at your own risk. Nothing on the Platform constitutes legal, financial, agricultural, business, or investment advice. The Platform is available to persons aged eighteen (18) and over only.
2. Product Listings and Pricing
2.1 Vendor-Set Prices
All product prices are set by individual Vendors, not by AgriTrust. AgriTrust does not warrant the accuracy of any listed price. Where a Vendor lists a product at an incorrect price, the Vendor reserves the right to cancel the affected order. The Buyer will be notified and may search for similar products from other Vendors. AgriTrust is not liable for any loss or inconvenience arising from such cancellations.
2.4 Platform Service Charge
The price displayed to Buyers at checkout incorporates a Platform Service Charge added by AgriTrust which covers Paystack processing fees, goods-in-transit insurance, porter services, and AgriTrust’s platform service fee. This charge is disclosed at checkout before the Buyer confirms their order. AgriTrust does not warrant that the Platform Service Charge will remain fixed and reserves the right to revise it with notice to Buyers.
2.2 Product Descriptions and Images
Product descriptions and images are created by AgriTrust on behalf of Vendors to maintain a consistent standard. However, actual produce may vary in appearance, size, colour, and quality due to the natural variability of fresh agricultural products and seasonal fluctuations. Buyers are strongly encouraged to use the “Verify Before You Buy” WhatsApp feature to confirm the current condition and quality of produce before ordering.
2.3 WhatsApp Verification Images
Where a Buyer communicates with a Vendor via WhatsApp prior to purchase, such communications take place outside the AgriTrust Platform. AgriTrust is not a party to these communications and does not monitor, verify, or endorse any images or statements made by Vendors through WhatsApp or any external channel. AgriTrust does not accept liability for misleading or inaccurate images shared by Vendors through external channels.
Exception: Where it is established that a Vendor acted in bad faith by deliberately providing misleading images or misrepresentations prior to purchase, AgriTrust will refund the Buyer’s payment in full and arrange return of goods to the Vendor. The Vendor will bear the full cost of return transportation and will be subject to AgriTrust’s vendor conduct framework.
3. Market Intelligence Data
The Market Intelligence features on the Platform — including market activity scores, hub rankings, vendor counts, supply pipeline data, market day indicators, and related intelligence metrics — are provided for general informational purposes only.
AgriTrust makes no warranty that Market Intelligence data is accurate, complete, current, or reliable at any given time. Intelligence data is computed by automated systems and updated periodically. It may not reflect real-time market conditions, vendor availability, or supply levels.
Market Intelligence data does not constitute professional agricultural advice, business advice, financial advice, or investment advice of any kind. Users who make purchasing, business, or financial decisions based on Market Intelligence data do so entirely at their own risk. AgriTrust is not liable for any loss or expense arising from reliance on Market Intelligence data, including the cost of travel to a market hub based on hub activity indicators shown on the Platform.
4. Platform Availability
AgriTrust endeavours to maintain the Platform in continuous operation but does not warrant that it will be available at all times, uninterrupted, or error-free. The Platform may be temporarily unavailable due to maintenance, technical failures, server outages, or circumstances beyond AgriTrust’s reasonable control.
AgriTrust is not liable for any loss, missed opportunity, failed transaction, or consequential damage arising from Platform unavailability at any time, including during peak trading periods, flash sales, or market days.
5. Third-Party Links and External Services
The Platform may contain links to third-party websites, services, WhatsApp channels, social media profiles, and other external resources. These links are provided for convenience only.
AgriTrust has no control over, does not endorse, and accepts no responsibility or liability for:
- The content, accuracy, legality, or reliability of any third-party website or service;
- The privacy practices, data handling, or security standards of any third party;
- Any product, service, or information offered by any third party;
- Any harm, loss, or damage suffered as a result of accessing or relying on a third-party resource linked from the Platform.
Users access third-party links and services entirely at their own risk. AgriTrust recommends reviewing the privacy policies and terms of use of any third-party service accessed through the Platform.

The Platform and its communications may contain forward-looking statements regarding planned features, upcoming services, expansion plans, and other matters not yet implemented — including references to “Coming Soon” intelligence modules, planned vendor tools, and features described as in development.

To the fullest extent permitted by Ghanaian law, AgriTrust Marketplace Limited and its officers, employees, agents, and partners shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages;
- Loss of profits, revenue, data, goodwill, or business opportunity;
- Damages arising from reliance on any information or data on the Platform;
- Damages arising from Platform unavailability or technical failure;
- Damages arising from the acts, omissions, or misrepresentations of Vendors or third parties;
- Damages arising from access to or use of any third-party link or service connected to the Platform.
Where liability cannot be wholly excluded by law, AgriTrust’s total liability for any claim shall not exceed the total value of the specific transaction to which the claim relates.
9. Indemnity
By using the Platform, you agree to indemnify and hold harmless AgriTrust Marketplace Limited and its officers, employees, agents, and partners from any claims, liabilities, damages, losses, costs, and expenses arising from your use of the Platform, your reliance on any Platform content, or your violation of any applicable law or third-party rights.
10. Changes to This Disclaimer
AgriTrust reserves the right to amend this Disclaimer at any time. The updated Disclaimer will be posted on the Platform with a revised “Last Updated” date. Continued use of the Platform constitutes acceptance of any amendments.
11. Governing Law
This Disclaimer is governed by the laws of the Republic of Ghana. Any dispute arising from this Disclaimer shall be resolved by arbitration under the Alternative Dispute Resolution Act, 2010 (Act 798) of Ghana, conducted in Accra.
