AgriTrust Marketplace Limited (“AgriTrust”, “we”, “us”, or “our”) operates the online marketplace at https://agritrust-marketplace.com (the “Platform”). We connect market traders, agro-dealers, and other suppliers with buyers across Ghana’s 16 administrative regions.
This Privacy Policy explains how we collect, use, store, share, and protect your personal data when you access or use our Platform. It applies to all users: Buyers, Vendors (market traders and agro-dealers), Logistics Partners, and Wholesale Buyers.
We are committed to processing your personal data in accordance with the Ghana Data Protection Act, 2012 (Act 843). By registering on or using the Platform, you confirm that you have read, understood, and agreed to this Privacy Policy.

3. Personal Data We Collect
3.1 Buyers
- Full name, email address, and phone number
- GhanaPost GPS digital address and delivery address
- Ghana Card (National Identification) — for identity verification
- Purchase history and order details
- Payment information (processed by Paystack — we do not store card or MoMo credentials)
- Device information, IP address, and browsing/search activity on the Platform
3.2 Vendors (Market Traders and Agro-Dealers)
- Full name, store/business name, email address, and phone number
- Ghana Card (National Identification) — for seller verification
- Bank account details — for payment disbursement
- Tax Identification Number (TIN) — for compliance
- GhanaPost GPS digital address of your market hub or business location
- Store and product listing data, sales history, and transaction records
3.3 Logistics Partners
- Full name, email address, and phone number
- Vehicle registration details and driver’s licence information
- GPS tracking data during active delivery assignments
- Assignment and delivery history
3.4 Wholesale Buyers (Special Accounts)
In addition to standard Buyer data, Wholesale Buyers may provide business registration details, TIN, and recurring order preferences.
3.5 Automatically Collected Data
- IP address and approximate geographic location
- Browser type, version, and operating system
- Pages visited, time spent, and navigation paths
- Cookie identifiers (see Section 7)
4. How We Collect Your Personal Data
- Directly from you when you register, list products, or place orders
- Automatically through cookies, Google Analytics, and Facebook Pixel
- From Paystack in relation to transaction status and confirmation
- From logistics partners during delivery assignment and completion
- From the National Identification Authority for Ghana Card verification
5. How We Use Your Personal Data
5.1 To Operate the Platform and Fulfil Orders
- Processing and fulfilling orders
- Verifying the identity of Buyers and Vendors using Ghana Card details
- Facilitating payments via Paystack (MoMo, card, and direct bank transfer)
- Disbursing vendor earnings to registered bank accounts
- Coordinating delivery, including sharing your phone number and GhanaPost GPS address with logistics partners
- Managing your account, profile, and marketplace activity
5.2 To Ensure Platform Safety and Integrity
- Preventing fraud, money laundering, and unauthorised transactions
- Verifying Ghana Card and TIN details to comply with Ghanaian law
- Detecting and investigating suspicious activity
- Enforcing our Terms and Conditions
5.3 To Improve the Platform
- Analysing usage patterns through Google Analytics
- Using Facebook Pixel to understand traffic from social media
- Personalising your experience based on browsing and purchase history
5.4 To Communicate with You
- Sending order confirmations, delivery updates, and receipts
- Responding to enquiries and support requests
- Sending platform and policy updates that affect your account
- Sending promotional communications where you have given consent (opt out at any time)
5.5 Legal and Compliance Obligations
- Retaining financial records for seven (7) years as required by Ghanaian law
- Cooperating with lawful requests from Ghanaian regulatory bodies
- Fulfilling obligations as a registered data controller under Act 843
6. Legal Basis for Processing
- Contract performance — processing necessary to execute orders, fulfil deliveries, and manage vendor payments
- Consent — for marketing communications and cookie-based tracking
- Legal obligation — tax record retention and identity verification
- Legitimate interests — fraud prevention and platform security
7. Cookies and Tracking Technologies
- Essential cookies — required for the Platform to function (session management, cart)

8. How We Share Your Personal Data
We do not sell your personal data. We share it only as follows:
8.1 With Logistics Partners
Your phone number and GhanaPost GPS address are shared with approved logistics partners solely to complete your delivery. They are bound by confidentiality obligations.
8.2 With Paystack
Transaction data is shared with Paystack to process MoMo, card, and bank transfer payments. See paystack.com/privacy. We do not store your card details or MoMo PIN.
8.3 With Vendors
Your delivery address and order details are shared with the relevant vendor for fulfilment only. Vendors may not use your contact information for any other purpose.
8.4 With Google and Meta (Facebook)
Anonymised usage data via Google Analytics and Facebook Pixel as described in Section 7.
8.5 With Regulatory and Law Enforcement Bodies
Where required by Ghanaian law, court order, or to protect the safety of users or the public.
8.6 Business Transfers
In the event of a merger or acquisition, personal data may transfer. We will notify you before your data becomes subject to a different privacy policy.
9. International Data Transfers
Your data is stored on servers in France (EU), operated by Hostinger. France benefits from GDPR-level protections. Google Analytics and Facebook Pixel may process anonymised data on servers in the United States under standard contractual clauses. We ensure all transfers receive equivalent protection to that required under Act 843.
10. Data Retention
- Account data — retained while your account is active and for three (3) years after closure
- Financial and transaction records — seven (7) years (Ghanaian tax compliance)
- Identity documents (Ghana Card) — duration of account plus three (3) years
- Logistics GPS tracking data — ninety (90) days after each delivery
- Analytics data — per Google’s and Meta’s retention policies
11. Your Rights Under the Ghana Data Protection Act, 2012
11.1 Right of Access
Request a copy of your personal data by emailing info@agritrust-marketplace.com with the subject line “Subject Access Request”. We respond within thirty (30) days.
11.2 Right to Rectification
Request correction of inaccurate data. Update most information through your account settings or email us.
11.3 Right to Erasure
Request deletion of your data where no longer necessary or where you withdraw consent, subject to legal retention obligations (Section 10).
11.4 Right to Restrict Processing
Request that we pause processing your data in certain circumstances.
11.5 Right to Object
Object to processing based on legitimate interests, including direct marketing. Opt out via any marketing email or by contacting us.
11.6 Right to Data Portability
Receive your personal data in a structured, machine-readable format where technically feasible.
11.7 Exercising Your Rights
Email info@agritrust-marketplace.com with your full name, registered email, the right you wish to exercise, and a copy of your Ghana Card. We acknowledge within five (5) working days and respond fully within thirty (30) days.
11.8 Right to Complain
Lodge a complaint with the Ghana Data Protection Commission at dataprotection.org.gh.
12. Children’s Privacy
The Platform is strictly available to persons aged eighteen (18) and over. There are no exceptions to this requirement. AgriTrust does not knowingly collect personal data from persons under the age of eighteen (18).
By registering on the Platform, you confirm that you are eighteen (18) years of age or older. AgriTrust reserves the right to request proof of age at any time. If we discover that an account has been created by a person under eighteen (18), we will immediately terminate the account and delete all associated personal data without prior notice.

13. Data Security
- SSL/TLS encryption for all data in transit
- Access controls limiting personal data to authorised personnel
- Secure server infrastructure in France with Hostinger
- PCI-DSS compliant payment processing through Paystack
- Regular security reviews of the Platform and systems
14. Data Breach Notification
In the event of a breach likely to risk your rights, we will: notify affected users within seventy-two (72) hours; provide details of the breach and our remedial steps; report to the Ghana Data Protection Commission; and take all steps to contain and prevent recurrence.
15. Third-Party Links
The Platform may link to third-party websites. This Privacy Policy does not apply to those services. Please review their own privacy policies.
16. Changes to This Policy
We will update the “Last Updated” date and post a notice on the Platform when material changes are made. Continued use after the effective date constitutes acceptance.
17. Governing Law
This Privacy Policy is governed by the laws of the Republic of Ghana, including the Data Protection Act, 2012 (Act 843). Disputes are subject to arbitration as set out in our Terms and Conditions.
